1. Who we are

StreamKit ("Service") is operated by Bloome ("we", "us", "our"). By creating an account or using the Service, you ("you", "user") enter into a binding agreement with Bloome.

2. Acceptance

By accessing or continuing to use the Service you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are an individual you confirm you are of legal age in your jurisdiction.

3. The Service

StreamKit provides a browser-based soundboard, alert simulator, stream timer, and related streaming-creator tools. Some features are free; others ("Pro" features) require an active paid subscription or one-time purchase.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and keep it up to date.

6. Intellectual property

Bloome owns and retains all rights, title and interest in the Service, including all software, design, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your active plan.

You retain ownership of audio and other content you upload. You grant us a limited license to host, process and serve that content solely so we can provide the Service to you.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By purchasing a plan you also agree to Paddle's Buyer Terms, which govern payment, billing, taxes, renewals and refunds.

Subscriptions renew automatically at the end of each billing cycle until cancelled. You can cancel at any time from your account; you keep access until the end of the current paid period.

8. Service level

We work hard to keep StreamKit available, but we do not guarantee that the Service will be uninterrupted, error-free, or always available. We may modify, suspend, or discontinue features at any time.

9. Suspension and termination

We may suspend or terminate your access if you (a) materially breach these Terms, (b) fail to pay amounts due, (c) create security or fraud risk for us or other users, or (d) repeatedly or seriously violate our policies. On termination your right to use the Service ends immediately; we may delete account data after a reasonable period.

10. Warranties and liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the fees you paid to Bloome in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, goodwill, or streaming income. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

11. Indemnity

You will indemnify and hold harmless Bloome from claims arising out of (a) content you upload, (b) your unlawful use of the Service, or (c) your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Bloome is established, without regard to its conflict of laws rules. Disputes will be resolved in the competent courts of that jurisdiction.
